Please read these Terms of Service (“Terms”) carefully before using our website or opting into the communication services provided by Class Management LLC, DBA Kut Fitness (“we,” “us,” or “our”). By subscribing to our newsletter, providing your phone number, or checking the consent boxes on our forms, you agree to be bound by these Terms.

1. Website Owner, The Offering, and Binding of Terms
This website is owned and operated by Class Management LLC or Kut Fitness DBA. These Terms set forth the terms under which you may use our website, subscribe to our newsletter, receive SMS updates, and engage with our fitness services.

2. Program & Communication Description
Kut Fitness provides email and SMS updates to customers who have opted in through our website forms, booking widgets, or member portals.

- Email Communications: Includes regular newsletters, promotional materials, updates on new classes, and special offers.

- SMS Program: Includes appointment/class confirmations and reminders, gym status updates, customer service communication, and automated responses to inquiries initiated by you (such as Missed Call Text Back).

3. Age Requirement
By subscribing to our communications or opting into our SMS program, you represent and warrant that you are at least 18 years of age and possess the legal authority to enter into these Terms. Our services and SMS communications are not intended for individuals under the age of 18. If we become aware that a subscriber is under 18, we will immediately terminate their subscription.

4. Message Frequency
For our SMS program, message frequency varies depending on your interaction with our services, class bookings, and the status of your gym membership. You will typically receive messages only as necessary to fulfill your service requests or fitness updates.

5. Opt-Out & Help Instructions
To Unsubscribe from SMS: You can cancel the SMS service at any time. Just text STOP to our number. After you send the SMS message STOP, we will send you one final SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us.

To Unsubscribe from Email: You can click the "Unsubscribe" link at the bottom of any promotional email we send you.

6. Cost and Carrier Disclaimer
As always, message and data rates may apply for any messages sent to you from us and to us from you. If you have any questions about your text plan or data plan, please contact your wireless provider. Mobile carriers are not liable for delayed or undelivered messages.

7. Ownership of Intellectual Property
All content, materials, and intellectual property on the Kut Fitness website and in our communications—including but not limited to logos, trademarks, text, graphics, and images—are the exclusive property of Class Management LLC or Kut Fitness DBA. You agree not to copy, reproduce, distribute, or create derivative works from any content received from us without our express written permission.

8. Privacy Policy & Data Sharing
We value your privacy. Data obtained through our SMS program will not be shared with third parties for marketing or promotional purposes. This completely excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties. For more details, please review our full Privacy Policy.

9. Right to Change and Modify Terms
We reserve the right to modify these Terms at our sole discretion. We will notify you of any material changes via email or a prominent notice on our website. Your continued engagement with our services or subscription to our programs after any such change constitutes your acceptance of the new Terms.

10. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Class Management LLC or Kut Fitness DBA be liable for any indirect, punitive, incidental, special, or consequential damages arising out of or related to your subscription, SMS messaging, or use of our fitness services.

11. Choice of Law and Dispute Resolution
These Terms shall be governed by, construed under, and enforced in accordance with the internal laws of the State of Utah, without respect to its conflict of laws principles. Any and all claims or disputes shall be brought exclusively in the courts of competent jurisdiction located in Marriott-Slaterville, Utah.
